State legislator sues constituents for premises liability

Lake County, Indiana readers may be interested to know that slip-and-fall accidents do not only occur in grocery stores when workers there fail to clean up a spill on aisle five. These accidents can occur just about anywhere. Anytime a property owner is negligent and exposes visitors to a dangerous property condition resulting in an injury, the owner may face a premises liability lawsuit.

Interestingly, two constituents of a state representative are finding this out the hard way. The politician has filed a premise liability lawsuit against the couple. He alleges that he was jogging outside one day when he tripped and fell on a defective sidewalk outside their home. As a result, he claims he suffered from a separated shoulder and a bruised elbow. He also claims that he did not have health insurance at the time, and as a result, he amassed a substantial amount of medical expenses. The representative is seeking $50,000 in damages.
